In Florida, divorce and custody matters are governed by family law, which focuses on the dissolution of marriages, the division of assets, and the determination of parental responsibilities.

Divorce (Dissolution of Marriage): In Florida, a divorce can be filed by either spouse on the grounds of irreconcilable differences, with no need to prove fault. The process involves the equitable distribution of marital assets and liabilities, where the court divides property fairly but not necessarily equally. Issues such as spousal support (alimony), child custody, and child support may also be addressed during the divorce proceedings.

Child Custody: In Florida, child custody is referred to as “timesharing.” The court seeks to create a parenting plan that outlines the time each parent will spend with the child and their shared responsibilities in raising the child. Florida law prioritizes the best interests of the child when determining timesharing arrangements, considering factors such as the child’s relationship with each parent, the parents’ ability to cooperate, and the child’s needs. Courts encourage shared parental responsibility, but if one parent is unfit or unable to care for the child, sole custody may be awarded.

In both divorce and custody cases, Florida law aims to ensure fairness and prioritize the well-being of any children involved.
